Danny Masterson’s wife Bijou Phillips reason for divorce filing revealed: report

New claims have emerged about the circumstances surrounding Bijou Phillips’ shock decision to divorce Danny Masterson, just days after he was jailed for 30 years for raping two women.

Phillips, 43, submitted the legal documents on Monday after firmly supporting her husband, 47, throughout his trial and conviction.

In the filing, the actress – who shares nine-year-old daughter, Fianna, with Masterson – requested that she be awarded spousal support while terminating any support to him.

There was no mention of a prenuptial agreement. Phillips also asked that Masterson pay her legal fees and that she have sole custody of their child, with him having visitation rights.

It appeared to be a stunning public U-turn in Phillips’ support of Masterson, but a source has now appeared to shed more light on the situation to the Daily Mail, explaining that her reasons are “twofold”.

“Recently, friends and family have told her to be a mum first and to consider divorce because it really shows her daughter that eventually people need to be held accountable for what they do, even if it is someone they love,” the source said.

“Bijou also is doing it to protect her assets and protect her future.

“She doesn’t want to lose money and land and housing over a future civil lawsuit against Danny, she is looking to protect her future and that is one big reason she has pursued divorce.”

They continued: “Bijou will never say anything negative about Danny’s parenting skills, he is incredible in that department.

“Bijou loves Danny, always will, and really hopes that his sentence is eventually lessened and or reversed.”

Phillips and Masterson started dating in 2004 after meeting at a poker tournament in Las Vegas and tied the knot in 2011 in Ireland.

They welcomed their first and only child, daughter Fianna, three years later.

In May this year, Masterson was convicted of raping two women in his Hollywood Hills home between 2001 and 2003.

He was sentenced to 30 years’ jail earlier this month, and blew his sobbing wife a kiss in court as he was escorted out to begin serving his time.

Following his conviction, a source told People that Bijou was “shocked and devastated” over the ruling as she “wasn’t prepared for the verdict.”

“She never expected him to be found guilty,” the insider said.

“She couldn’t believe that he was taken into custody right away and remanded.”

The source added that she “supports” him and had “no plans to leave him”.

It was a sentiment echoed by another source to the Daily Mail a fortnight ago, who claimed that Phillips “believes” her husband’s denial of wrongdoing.

“She is hanging on to the fact that she completely trusts he never did what he was charged for, she can’t accept that to be true, and she is looking to the appeal process for justice to be served.”

She also wrote a letter to the judge ahead of his sentencing to advocate for why the actor should get a more lenient prison sentence.

“We need him more than you can imagine,” the former model wrote of her and her daughter.

“I know he has been convicted of serious crimes. But the man I married has only been an extraordinary husband to me and a devoted father to our daughter.”

However, just 12 days after his incarceration, Phillips officially filed for divorce.

She listed the date of separation as “TBD”, which means to be determined, in the document filed on Monday and cited irreconcilable differences as the reason for the split.

A spokesman for the former actress and model confirmed the news to TMZ, explaining: “Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter.”

The lawyer added: “This period has been unimaginably hard on the marriage and the family. Mr. Masterson was always present for Ms. Phillips during her most difficult times of her life. Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter.”
